Terms and conditions for all rental contracts


1) A contract between the person who makes the booking and the accommodation's owners comes into existence when the booking deposit has been paid and receipt acknowledged either by email or via the villabreak spain web-site. The person in whose name the booking is made (the principal booker) acts on behalf of all the persons in the party.

2) Payment can be made via credit card or by bank/electronic transfer directly into the nominated bank account. Details will be supplied at the time of booking.

2b) The principal booker agrees to pay the full cost of the accommodation in the denominated currency including any rental items, receiving charges or exchange rate differences no later than 6 weeks(42 calendar days) prior to the arrival day and understands that failure to do so may result in the loss of the accommodation and booking deposit and or incur late payment penalties as set out on the www.villabreakspain website faq section.

3) A Surety or Inventory Deposit (amount varies with property booked) may be payable at the same time as the balance for the booking. The deposit will be refunded by electronic bank transfer within 14 days of your departure from the property, less deductions for any breakage, damage and/or loss of keys. Bank charges and exchange rate charges may also be applied to the inventory deposit. The principal booker agrees to pay the owner for the cost of repairing or replacing (as decided by the owner and or his agent) any item belonging to the property that is damaged due to negligence or wilful default of the guest party during the occupation period.

4) The owner has the right of access to the property at any time, for the purpose of inspection and maintenance. When making the booking the names of all of the party must be included together with the ages of children and infants.The full address and contact details of the principal booker must be included. The total number of guests must not exceed the stated number specified on the booking form unless agreed in writing, in advance. If the number of guests exceeds the maximum number specified for the property, any extra guests that were not notified to, or agreed by, the owner, will be subject to expulsion from the property.

5) In extraordinary cases, the owner or the owner's agents reserve the right to change the property booked. Whenever possible such a change will be notified in advance of your arrival. The alternative property offered will be equal to or superior to the property booked as defined by size of accommodation and amenity. If no suitable alternative property is offered or available, a claim for a full or partial refund of the monies paid to the owner will be upheld. We regret we cannot pay any expenses, costs or losses incurred by you as a result of any change or cancellation made necessary by circumstances beyond our control.

6) As agents we do not accept responsibility for death, personal injury, or any failure or deficiency in respect of your accommodation arrangements with the owner, nor for failures to power and water supplies. It is your responsibility to show that reasonable skill and care has not been used if you wish to make a claim against the owner with whom your contract is held. In the event of any faults or deficiencies, you must make the owners aware in a timely fashion by contacting both ourselves and the house manager, if necessary, in writing. You are obliged to give the owners the time necessary to resolve the problem. If no complaint has been received, and you leave the property prematurely and without the explicit agreement of the owners, you forfeit your rights to a refund on the proportion of the rental paid to the owner. Complaints that are not received until the end of the stay will not be taken into consideration and no refunds will be given.

7) The property may not be available for occupancy until 16:00 hours on the day of arrival, although every effort will be made for it to be ready as early as possible, subject to cleaning and preparation being complete. At the end of your stay, the property must be vacated by 10:00 hours on the day of departure, unless a later departure has been agreed in advance with the owners.

8) If it becomes necessary for the reservation to be cancelled, we require notification in writing from the principal booker. The owners will then acknowledge the cancellation, confirming the value of the deposit or full payment that is forfeited.

9) We expect all guests to show consideration for other people. If, in our opinion, or the opinion of any other person in authority, any member of your party behaves in such a way as to cause, or be likely to cause danger, upset or distress to any third party, or damage to the property, or in any way damage the reputation and/or goodwill of the owners, the owners will be entitled, without prior notice, to terminate the occupation of the person(s) concerned. In this situation, the person(s) concerned will be required to leave the accommodation and we will have no further responsibility towards such person(s). No refunds will be made, nor will the owners pay any expenses or costs incurred as a result of the termination.

10) Many properties offer TV with English speaking channels, transmission being obtained via satellite system, according to local facilities and laws. Due to circumstances such as distance, methods of transmission, satellite positioning, signal strength, on occasions weather, and local licence procedures, we do not guarantee the availability of these facilities, although we will always do our best to restore any failures that may occur.

11) The property that is let forms part of a private dwelling, rather than a tourist residence. It therefore reflects the personal taste of the owner and the culture, traditions and standards that make the property distinct. It is possible that such differences may result in minor inconveniences which cannot be accepted as complaints. Windows and patio doors in Spain are not necessarily fitted with safety glass.

12) Spanish law governs this contract and all matters arising from it. Any dispute arising from, or connected with your contract with the owners will be dealt with by the courts of Spain.

13) Should any part of this contract be proven to be defective or unfair in court the parties agree that the remainder of the contract shall continue to be binding and remain in force.

14) The principal booker undertakes to ensure that all members of their party are covered by adequate travel insurance to include accident and medical expenses whilst in Spain.
